Minister of State for Electronics and Information Technology Jitin Prasada has said that the government is cognizant of the need to create guardrails to ensure that AI is safe and trusted. In a written reply in the Lok Sabha yesterday, Mr. Prasad said that the Central Government has notified the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 (“IT Rules, 2021”) in 2021, which were subsequently amended in 2022 and 2023.
The Minister added that the IT Rules 2021 cast specific legal obligations on intermediaries, including social media intermediaries and platforms, to ensure their accountability towards safe and trusted internet, including the removal of the prohibited misinformation and deep fakes. He also informed the House that the Digital Personal Data Protection Act, 2023, has also been enacted, which casts obligations on data fiduciaries to safeguard digital personal data, holding them accountable.
